Dealers ask the same billing questions again and again, in showrooms, in WhatsApp groups, and in Google searches at 9 pm. Here are direct answers, without the legal fog.

1. Can I sell a car without a bill?

Physically, yes. Sensibly, never. The bill and sale letter timestamp the moment liability moved to the buyer. Without them, every challan, toll violation and worse stays pointed at the name on the RC, which is yours until the transfer completes.

2. Is a bill of sale legally binding?

Yes, as evidence of the transaction between the parties. But it does not transfer ownership at the RTO. That requires Form 29 and Form 30. Full explainer: bill of sale in India.

3. Does GST apply when an individual sells an old car?

4. What is the HSN code on a car invoice?

8703 for passenger vehicles, 8711 for two-wheelers. It must appear on every GST invoice a registered dealer issues.

5. Invoice, bill of sale, sale letter, receipt: which is which?

6. Is an e-signature valid on car documents?

For the private contract between buyer and seller, yes, under the IT Act, 2000. For RTO submissions, plan on wet signatures or the Parivahan e-KYC route, depending on your state.

7. What if the buyer loses the invoice?

8. Should the invoice show the buyer's PAN or Aadhaar?

For cash transactions above Rs 2 lakh, PAN is required. Below that it is optional but sensible on high-value sales, since the same identity goes onto Form 30.

9. Can I bill in the buyer's regional language?

You can add a translation, but keep the primary document in English or Hindi with standard numerals so the RTO, insurer and bank read it without friction.

10. What should a token advance receipt say?

Buyer name, vehicle registration number, amount received, balance due, and the condition under which the token is refundable. Format and template: token advance receipt.

11. How long must a dealer keep sale records?

At least 72 months under GST rules, and practically longer for the sale letter, since ownership disputes surface years later.

12. Who bills on a consignment sale?

Whoever legally sells. Dealer-owned stock means the dealer invoices the car. Pure facilitation means the owner sells to the buyer and the dealer invoices only the commission.

Frequently asked questions

Can I sell a car without a bill?

You can hand over a car without paperwork, but you should never do it. Without a bill and sale letter there is no record of when liability transferred, the buyer cannot complete the RC transfer cleanly, and every future challan or legal notice lands on the seller. A bill costs two minutes; its absence can cost years.

Does GST apply when an individual sells their old car?

No. GST applies to used-vehicle sales only when the seller is a GST-registered dealer, and even then only on the margin between purchase and sale price under Rule 32(5) of the CGST Rules. A private individual selling their own car charges no GST.

Is an e-signature valid on car sale documents in India?

Electronic signatures are legally recognised under the IT Act, 2000 for most contracts, so an e-signed sale agreement between two parties is valid. However, RTO forms like Form 29 and 30 are physical submissions in most states and need wet signatures or the Parivahan portal's Aadhaar-based e-KYC flow.

What if the buyer loses the invoice?

Reissue a duplicate marked as a copy, with the same invoice number and date as the original. Never issue a fresh invoice number for the same sale, as that creates a phantom second transaction in your GST records. Cloud storage avoids the problem entirely.

Is a payment receipt different from an invoice?

Yes. The invoice records what is owed for the sale; a receipt acknowledges money actually received. For a car sold with an advance, good practice is a token advance receipt at booking, the invoice at sale, and a final receipt when the balance clears.

Who issues the bill when a dealer sells on consignment?

It depends on who legally sells. If the dealer purchases the vehicle into stock and resells, the dealer invoices. If the dealer only facilitates between the owner and buyer for a commission, the sale documents run owner to buyer and the dealer invoices only the commission with regular GST.
