What a bill of sale is (and is not)

A bill of sale is the contractual record of the sale between the seller and the buyer. It proves the transaction happened. What it does not do is transfer legal ownership of the vehicle. In India, ownership of a motor vehicle changes only when the RTO records the transfer on the Registration Certificate, which requires Form 29 (the seller's notice) and Form 30 (the buyer's application).

What a complete vehicle bill of sale includes

Stamp paper, notarisation and witnesses

No central law requires a private vehicle bill of sale to be notarised. Common practice in India is to execute the sale letter on non-judicial stamp paper or have it notarised, and to add two witnesses. Each step raises the evidentiary weight of the document if a dispute ever reaches a court or the RTO questions the transaction. For dealer sales, a printed sale letter on the dealership letterhead with witness signatures is the standard.

The seller stays legally liable for a vehicle until the RC transfer completes. Challans, accidents and worse trace back to the name on the RC, not the name on the bill of sale. Is a bill of sale legally binding in India?

Yes, a signed bill of sale is valid evidence of the transaction between buyer and seller. But on its own it does not transfer vehicle ownership in the eyes of the RTO. Legal ownership of a motor vehicle changes only when the transfer is recorded on the Registration Certificate through Form 29 and Form 30 under the Central Motor Vehicles Rules.

Does a car bill of sale need to be notarised or on stamp paper?

There is no central rule that requires notarisation for a private vehicle sale. Many dealers and buyers execute the sale letter or sale agreement on non-judicial stamp paper (commonly Rs 100 or as per state practice) or get it notarised for stronger evidentiary value. It is good practice, not a legal precondition.

What is the difference between a bill of sale and an invoice?

The invoice is the financial record of the transaction showing the price and tax breakup. The bill of sale (called a sale letter or sale agreement in India) is the contractual record of the transfer, covering the vehicle identifiers, the as-is condition, delivery and both signatures. A complete used-car sale should have both.

Can a bill of sale be handwritten?

A handwritten bill of sale is valid if it identifies the parties, the vehicle (registration, chassis and engine numbers), the price and the date, and both parties sign it. A printed document is strongly preferred because handwriting errors on a 17-character chassis number are the most common cause of RTO rejection.
